State Maritime Concessions

The allocation of State Licenses is divided into three phases: presentation of the application form, with the required supporting documents, the preliminary investigation procedure and the final decision. In the preliminary phase, which includes the publication of the application pursuant to ex art. 18 Code of Navigation Regulations, the recommendations of specific Port Authority departments and other Public Administrations, if necessary, will be requested and incorporated. The preliminary investigation procedure will terminate with a final decision taken by the Port Authority Management Committee.

If the preliminary procedure terminates with a positive outcome, the License will be issued upon the payment of the fee in advance and the presentation of the required state guarantee, and will be registered with the Registry Office of the Tax Agency. If the application is rejected, notification of the rejection shall be provided.

Please note that territorial deep water concessions are also issued by the Port Authority to authorise the installation of equipment or the undertaking of specific activities (buoys, floating docks etc.), and the removal of sand along the shoreline.

In the event that the site in question is subject to the presentation of over one application, the bids will be subject, in compliance with art. 37 of the Code of Navigation Regulations, to a comparative analysis.

Please note that the applications will be published in accordance with ex art. 18 Regulations for the Implementation of the Code of Navigation, and the costs will be borne by the applicant, in compliance with art. 11 Regulations for the Implementation of the Code of Navigation.

State Licenses

To request a state license it is necessary to submit the following documents:

Form A.0 (doc - pdf ), duly completed, and with the following supporting documents:

  • Antimafia Self-declaration as per attached form;
  • Ministerial Form, within 20 days upon the presentation of Form A.0, www.sid.mit.gov.it/login, specifically:
    Ministerial Form D1 if the form is being submitted for the first time
    Ministerial Form D2 if Form D1 has already been compiled and submitted, in compliance with the instructions provided;
  • An update of the property registry data, also for local taxation purposes;
  • Guarantees required to match the obligations outlined within the concessionary contract.

The concessionaire, for the entire duration of the concession, must insure all the infrastructure and assets subject to the concession, including the common user parts (if any) and the fixed installations - as well as guarantee the Port Authority against environmental damage in the event that the concession also includes a port water area and/or the concessionaire handles products susceptible to spillage - with a major Insurance Company accepted by the Port Authority - against damages for any risk insurable with an All Risk policy that must include the clauses set forth in the attachment and cover the Port Authority as beneficiary. The concessionaire must transmit a copy of the policy within 30 days from the completion of the License.
